The agreement between you and KennelOS

1. This agreement

These terms are an agreement between you and KennelOS ("KennelOS", "we", "us"). They cover this website, the KennelOS apps (Lite, Pro, the demo and Furever), our online service (cloud backup, private backup and the online waitlist) and the waitlist pages families use. By using any of them you agree to these terms and to our privacy policy. If you use KennelOS for a business, you agree on its behalf.

Plain English is the goal. Where a sentence sounds like a lawyer wrote it, it's there because it has to be.

2. What KennelOS is

KennelOS is a record keeper for dog breeders that runs in your web browser and stores your records on your own device. Lite is free, with a limit on adult dogs and litters. Pro is paid, with no limits and more features. The demo is Pro with sample data, and saves nothing. Furever is a free app for puppy families. The online service is optional: every app works without it.

3. Who can use it

You must be at least 18, or the age of majority where you live, and able to make a binding agreement. Waitlist applicants and families using a kennel's pages must also be adults.

4. Your records are yours

Everything you enter stays yours. We claim no ownership of it. Where our online service stores or sends your records, you give us permission to do that only as needed to run the features you turn on, as described in the privacy policy. That permission ends when you delete the data.

5. Keeping your records safe

Your records live in your browser's storage on your device. Clearing your browser's data, uninstalling the browser, or losing or resetting the device can erase them, and we can't recover what was only on that device. You are responsible for keeping your own backups: export a backup file regularly, and turn on cloud backup (and private backup, for your private details) if you want a copy held for you. Cloud backup reduces this risk; it doesn't remove it.

6. Cloud backup, private backup and your account

• It's optional and free in Lite and Pro. You sign in with your email and a code we send you. Keep access to that email, and keep your devices locked: anyone who can read your email or open your unlocked device may be able to reach your backup.
• Private backup is encrypted with a key we never have. If you lose your recovery code, every passkey and every unlocked device, nobody, including us, can open it. That's the point of it, and it means we can't help you get it back.
• Fair use. Cloud backup is for one breeding program's records. We may limit storage, requests or documents to keep the service running for everyone, and we'll tell you in the app if you reach a limit.
• You can delete it at any time from the app (Delete my cloud data).
• It's provided as is. We work hard to keep it running and your backups intact, but we don't guarantee it will always be available or that no backup will ever be lost. Keep your own backup file as well.

7. Other people's information

Your records will hold details about other people: buyers, co-owners, vets, families on your waitlist. You're responsible for collecting, keeping and sharing them lawfully, for having any agreement you need, and for answering their requests about their information. Companion and Furever links, the online waitlist and the emails it sends all share information you choose to share; please check what you send.

8. The online waitlist (Pro)

For breeders: the online waitlist needs Pro, cloud backup and a signed-in account our service knows is Pro. You decide your questions, rules, fees, offers and the emails sent in your kennel's name, and the service follows the settings you choose, including automatic offers and reminders while your phone is off. You are responsible for what you publish and send, for your dealings with families, and for any fees, deposits or sales between you. KennelOS isn't a party to them and doesn't take or hold any payment.

For applicants and families: your agreement about a puppy is with the kennel, not with KennelOS. The kennel decides who is approved, offered or declined. Use the pages honestly and only for your own application. Questions about your place, fees or a puppy go to the kennel.

9. Pro: licenses, payment and refunds

• The license. Buying Pro gives you a personal, non-transferable license to use the Pro app for your own breeding program, on the devices your plan's activations allow, for as long as your plan is active. Please don't share or resell your key.
• Payment. Pro is sold by Lemon Squeezy, as merchant of record. Your purchase, billing, taxes and receipts are handled under their terms, and they send you your license key.
• Plans. Monthly and yearly plans renew automatically until you cancel; cancelling stops the next renewal, and Pro works until the end of the period you've paid for. The yearly plan starts with a 7-day free trial. A lifetime purchase is a single payment with no renewal. Current prices are on the Pro page.
• Checks and grace windows. Pro confirms your key with Lemon Squeezy when it can reach the internet, and keeps working offline for a grace window (3 days monthly, 7 days yearly; lifetime runs 3 months between checks, with a further month's warning). A key that's refunded, cancelled and expired, or not valid stops unlocking Pro.
• Refunds. If Pro isn't right for you, email us and we'll sort it out. Refunds are issued through Lemon Squeezy. This doesn't limit any right to a refund you have by law.
• When Pro ends. Your records stay on your device. Pro will ask you to renew before you keep working in it, so export a backup while your plan is active; a program that fits Lite's limits can be imported into Lite.
• Price changes. We may change prices for future purchases and renewals. We'll show a new price before it applies to you, and you can cancel before it does.

10. Acceptable use

Please don't:

• use KennelOS for anything unlawful, including unlawful sales of animals or fraud;
• use the waitlist emails to send spam, or to contact anyone who hasn't applied to you;
• upload or publish anything you don't have the right to, or that is abusive, deceptive or harmful;
• try to get into someone else's account, data, waitlist or status page;
• probe, overload or disrupt our service, or get around its limits or the Lite or Pro license checks;
• use bots or scripts against the online service or the application forms.

If you do, we may limit or close your access to the online service (see section 15).

If you find a security problem, please email us before telling anyone else. We'll thank you and fix it.

11. Our software and name

The KennelOS apps, website, service, name and logo belong to us. We give you permission to use them as these terms allow, and nothing more. Don't copy, resell or publish the apps as your own, or use our name in a way that suggests we endorse you. If you send us ideas or feedback, we may use them freely, with no obligation to you.

12. Other services

Some features rely on other companies: Lemon Squeezy (payment and licenses), Dropbox (Pro's Dropbox backup, if you connect it), Cloudflare (our hosting), Resend (email), GitHub (website hosting), and links you add to Facebook or elsewhere. Their own terms apply to your use of them, and we're not responsible for their services.

13. Not professional advice

KennelOS helps you keep records and reminders. It isn't veterinary, legal, tax or financial advice. Due dates, health-test suggestions, reminders, breed information, contract and email templates and reports are aids, not guarantees: check anything that matters with the right professional, and with your registry for registration rules.

14. Changes to KennelOS

We keep improving KennelOS, which means features will change, and some may be added to Pro or removed. If we ever stop running the online service, we'll say so in the app well ahead of time, so you can make sure your records are on your devices or in a backup file. The apps keep working without it.

15. Ending this agreement

You can stop using KennelOS at any time; deleting your cloud data and cancelling any plan closes everything on our side. We may suspend or close your access to the online service if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the service. Where we reasonably can, we'll tell you first and give you a chance to take your data. Your records on your own devices are never affected. Sections 4, 7 and 11 to 19 continue after this agreement ends.

16. Disclaimers

KennelOS is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that KennelOS will be uninterrupted, error-free or secure, or that data will never be lost.

17. Limits on liability

To the fullest extent the law allows, KennelOS will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of KennelOS, even if we were told they were possible. Our total liability for any claim about KennelOS is limited to the greater of the amount you paid us for Pro in the 12 months before the claim, and US $50.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits a right you have as a consumer that can't be waived by contract, or liability that can't legally be limited.

18. Governing law and disputes

If something goes wrong, email us first: most problems can be fixed quickly that way. These terms are governed by the laws of the United States, without regard to conflict-of-law rules, and disputes will be heard by courts in the United States, unless the law where you live as a consumer gives you the right to bring a claim in your local courts or under your local law.

19. General

These terms and the privacy policy are the whole agreement between us about KennelOS. If any part is found unenforceable, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to. You can't transfer this agreement without our agreement; we may transfer it to anyone who takes over KennelOS, and these terms would still protect you.

20. Changes to these terms

We may update these terms. We'll change the dates at the top, and if a change matters to you, we'll say so in the app before it takes effect. If you keep using KennelOS after that, you accept the new terms; if you don't agree, you can stop using it and delete your cloud data.
